Think employment contracts are uncomplicated? Think again!

Binding contracts occur when one side makes an offer and the other accepts, when value has been exchanged, or when parties intend to form a contract. This means that all employees have employment contracts, whether written down or not. These generally involve a promise to hire in exchange for a promise to work, with specific terms and conditions varying in accordance with the parties’ intentions.

The terms that make up these contracts can contain many pitfalls and loop holes. Chances are you won’t know even about these issues until the contract has been signed and sealed. Moreover, legislation now makes written particulars of employment peremptory!

As an employer, what should you do?
All employment agreements must comply with the Basic Conditions of Employment Act, as well as with various common-law principles. Besides the express terms of an employment contract, they also often contain implied terms and these are the ones that generally pose a risk to the employer.

Take steps to avoid risks and liability by knowing the limits of particular clauses, as well as the extent of certain statutory and common-law rules. The wise move? Hire an expert to draft and implement all employment contracts in your business to avoid any nasty surprises.

ABOUT THE TRAINER
Nic Nortje obtained B.A. and LL.B degrees from the University of Natal, and after a (few) GAP years, he returned to SA to consult in Labour Relations to the Quest Group. A few years later he left to start NORTJE & ASSOCIATES, a consulting firm providing employment, labour and management services. After 10 years, N&A was rebranded as NKR, and Nic consolidated all the services under the umbrella of outsourced HR. He has since grown NKR to become an consulting firm in outsourced HR solutions. The business celebrated its 18th year in May 2016. Nic is a labour relations, HR and people management expert, a seasoned negotiator and training facilitator as well as a business strategist. He has more than 2 decades experience across all industries. He has also served in many representative and leadership roles, including Executive Director of SACMA, Board Member of the KZN CTC and 2 terms as part-time CCMA Commissioner. Nic plays league squash, collects wine and makes tea for his wife EVERY morning without fail…..
